Terms and Conditions for AimCam Film Rewards Promotion

AimCam wants to thank you for taking the time to share your footage with us and we can’t wait to “see it your way” but before submitting your content please read the following terms and conditions carefully.

By submitting your content (The content) you are licencing the use of your content to AimCam. Before submitting content, you must undertake you are over 18 years of age or have parental/guardian consent and are able to understand these conditions.

In order to submit content as part of the AimCam rewards promotion, you must complete the form below in full.  Failure to complete all or part of the form including details of a PayPal account by which you can receive royalty payments may render your content ineligible.  By submitting your content, you agree to the collection, retention, usage and distribution of your personal information in order to process and contact you about your participation in the promotion.  AimCam will not sell or share your information with third parties.

By submitting content to AimCam you are confirming that you are the legal owner of the copyright in the content submitted and that where the content includes images/likenesses of third party individuals that you have their express consent to licence the content to AimCam without limitation.  AimCam reserve the right to ask for proof of this before making royalty payments. If another person has filmed content which you are submitting, you warrant that you have received an assignment of all associated copyright to that content from that person. AimCam may ask to see evidence of that assignment at any time.  Only the person submitting the content and warranting that they own the copyright is eligible for the payment of royalties.  You agree to indemnify AimCam Limited against any breach of third party copyright whether intentional or accidental in any content you submit.

By submitting content to AimCam you are granting a binding non-exclusive licence to AimCam to use your submitted content in any way they wish including but not limited to, online and offline publishing for the purpose of advertising of AimCam products, public display, sub-licensing to third parties, the right to reproduce, modify, display and prepare derivative works including the creation of new materials including stills and images taken from the content, incorporation of the content into marketing materials and the use of the content to generate income by various means.

By providing your name and any details relating to the content you are granting AimCam the right to use your name and details as part of their licenced use of the content.  The right to use your name, and town or city of residence for the sole purpose of identifying you as the creator of your content and/or as a participant in the promotion.  If you do not wish to have your name included for this purpose you must tick this box □

You undertake that in submitting content you will not include falsehoods or misrepresentations that could damage AimCam or any third party.  You will not post advertisements or solicitations of business, or impersonate another person.  You will not submit any material which is obscene, defamatory or otherwise objectionable, or unlawful.

If your submitted content includes music or graphics in addition to your filmed footage, you may be either asked to submit a version without the addition of music or graphics or to confirm that appropriate copyright licences are in place.

Submission of content is not a guarantee that the content will be used.  Submitted content will only be published at the sole discretion of AimCam and its partners.  Content which is deemed unsafe or likely to incite unsafe behaviour in others or deemed otherwise inappropriate in the context of the safe and humane enjoyment of shooting sports will not be eligible.

Where content is used you will be notified and rewarded accordingly – see reward terms below.  Where content is deemed unsuitable for use you will be notified of the decision but no payment will be made.  Where no payment is made no licence is given.

Content will be judged at the sole discretion of AimCam Limited.

Reward Terms

• Acceptance and use of content for any purpose by AimCam will be rewarded by a fixed licence fee of $30
• Content that is judged sufficient quality to be incorporated into our “best of”, “best shots” or Training categories will be rewarded with a licence payment of up to $500 at the sole discretion of AimCam and subject to AimCam receiving the “Raw” unedited content in high resolution.
• A panel of AimCam staff will judge all submissions on or around the last day of every month. The chosen participants will be contacted within 14 days of the decision. AimCam’s decision is final and binding relating to this $10,000 giveaway beginning February 1^st 2019 and ending on February 1^st 2020 @ 12 pm GMT.
• All rewards payment will be made by either PayPal or Bankers Check made out in the name of the submitting person.

Payments made under these terms will be classified as Licence royalties and you are responsible for the paying of any taxes appropriate to any such payment.

These terms do not constitute a contract of employment and you may not represent that you are an employee, agent, partner or subcontractor of AimCam or any of its subsidiaries.

AimCam takes no responsibility for content submissions that are lost, delayed, misdirected or incomplete or cannot be delivered for any technical or other reason.

AimCam reserve the right at any time and from time to time to modify or discontinue, temporarily or permanently, this promotion with or without prior notice due to reasons outside their control (including, without limitation, in the case of anticipated, suspected or actual fraud). The decision of AimCam in all matters under its control is final and binding.

These terms are subject to change at any time and any such change will be published on our website.  These terms and conditions will be governed by English law and shall be subject to the exclusive jurisdiction of the courts of England and Wales.
